Cemetery Property Ownership Deed
How to clear the title on cemetery property ownership rights.
When a person dies and does not leave instructions on how to dispose of unused cemetery grave plots, then an affidavit of heirs has to be created with the cemetery to show who has the rights to inherit the cemetery grave plots that have been left unused.
An affidavit of heirs will show who the heirs at law are that are blood related to the original cemetery lot owner. This affidavit of heirs gives the cemetery the authority to allow a named heir to use the grave plots, when a heir to the original owner, has a death and is requesting to be buried in the family plot.
This does not mean that the heir of the original owner has to be buried there, only that they have a right to be, if the family of the deceased so chooses too. Then again if there are lets say five heirs to the original cemetery lot owner and only three spaces left, then it becomes first come, first served, so to speak.
Also there could be an “heirs release of interest”, where one heir gives up their right of burial to another heir. Check with your local cemetery to see what their rules an regulations are regarding inheritance laws.
